Terms of Service

Welcome to TanTan. These Terms of Service (“Terms”) govern your access to and use of our mobile application, website, and related services (the “Services”). By using the Services, you agree to these Terms.

1. Who we are

The Services are offered by TanTan and its affiliates (together, “we”, “us”). If you are using the Services on behalf of an organization, you represent that you are authorized to agree to these Terms for that organization.

2. Eligibility

You must be old enough to enter a binding contract where you live and meet any minimum age that applies in your region. If you are under the required age, you may use the Services only with a parent or guardian’s permission where that is required by law.

3. Accounts

Some features may require an account. You are responsible for your account credentials and for activity that occurs under your account. Notify us if you become aware of unauthorized use.

4. License to use the Services

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services in line with these Terms. You will not: reverse engineer, scrape, or attempt to access non-public areas; interfere with the Services; use the Services in violation of law; or misuse other users’ content or personal data.

5. Your content

You may submit content (e.g. audio, text, or practice materials) through the Services (“Your Content”). You retain ownership of Your Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display Your Content as needed to run, improve, and secure the Services, and to provide features such as pronunciation feedback.

You are responsible for Your Content and must have the rights to share it. Do not upload unlawful, harmful, or infringing content.

6. Proprietary rights

The Services, including software, design, text, and branding, are protected by intellectual property laws. These Terms do not grant you any rights in our marks or code except the limited license above.

7. Third-party services and links

The Services may include links or integrations with third parties (e.g. the App Store). Those services have their own terms and privacy practices; we are not responsible for them.

8. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Services will be error-free, uninterrupted, or that learning outcomes or pronunciation results will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, TanTan and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim related to the Services is limited to the amount you paid us for the Services in the twelve (12) months before the claim (or, if you have not paid, to fifty U.S. dollars (USD 50)), except where such limitations are not allowed by law.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless TanTan and its officers, employees, and partners from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms.

11. Termination

We may suspend or terminate access to the Services if you violate these Terms, create risk, or for operational reasons, with or without notice where allowed by law. You may stop using the Services at any time. Provisions that by nature should survive (e.g. ownership, disclaimers, limitations, indemnity) will survive.

12. Changes to the Services or these Terms

We may modify the Services or these Terms. We will post updated Terms and may notify you in the app or by other reasonable means. If you keep using the Services after changes, you accept the new Terms, except that material adverse changes will apply as required by law.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction we designate for your region (or, if none is stated, a neutral set of terms intended for a global audience), without regard to conflict-of-law rules. Courts or arbitration in that jurisdiction may have exclusive authority over disputes, subject to your mandatory consumer rights in your home country.

Our Privacy Policy explains how we collect and use personal data. It is part of these Terms by reference.

16. Entire agreement

These Terms, together with the Privacy Policy and any additional terms we provide for specific features, are the full agreement between you and TanTan regarding the Services, and supersede prior understandings on the same subject.
